Welcome to Golden Mind. These Terms of Service ("Terms") govern your use of the Golden Mind mobile application and website (collectively, the "Service") operated by Thunder Rebel LLC, doing business as LuxWeb Studio ("we," "us," or "our"). By accessing or using the Service, you agree to be bound by these Terms.

1. Acceptance of Terms

By downloading or using Golden Mind, you confirm that you have read, understood, and agree to these Terms. If you do not agree, please do not use the Service.

2. Eligibility

Golden Mind is designed for adults, especially those 65 and older. It is not directed at children under 13, and you must be at least 13 years of age to use it. If you are under 18, you represent that your parent or legal guardian has reviewed and agreed to these Terms on your behalf.

3. Pricing

Golden Mind is 100% free. There are no ads, no accounts, and nothing to buy.

4. Not Medical Advice

Golden Mind's brain games and daily check-in are offered for enjoyment and general wellbeing only. They are not medical devices and do not diagnose, treat, prevent, or monitor any disease or condition, including memory loss or dementia. Talk to your doctor about any health concerns.

5. AI-Generated Content (Goldie)

Goldie is an AI companion in Golden Mind. Goldie is not a person, and not a doctor, nurse, therapist, lawyer, or financial advisor. Its replies are AI-generated and are not professional, medical, psychological, legal, or financial advice. Do not rely on Goldie in place of a qualified professional.

AI-generated responses may be inaccurate, incomplete, or inappropriate. Use your own judgment before acting on anything Goldie says. We make no warranties regarding the accuracy or completeness of AI-generated content.

In an emergency, do not use Goldie. Call 911 right away. If you are thinking about harming yourself or are in emotional crisis, call or text 988 (Suicide & Crisis Lifeline) in the US.

Goldie is used only after you give one-time consent in the app. When using Goldie, you agree not to use it to generate unlawful, harmful, harassing, or abusive content, and not to attempt to bypass its safeguards. Your messages are processed by a third-party AI service provider as described in our Privacy Policy.

6. User Content

• Your Content: You retain full ownership of all content you create within Golden Mind, including your voice recordings, life stories, transcripts, "My Life Story" book, check-ins, and the messages you send to Goldie.
• Our Content: All other content within the Service, including design, branding, games, AI-generated text, and app features, is owned by Thunder Rebel LLC and protected by intellectual property laws.

7. Your Data

Your data is stored only on your device. There is no account or cloud backup, so if you delete the app or lose your device, your data cannot be recovered by us. You are responsible for keeping your device secure.

8. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose or in violation of these Terms.
• Use the Service to abuse, harass, or harm others.
• Record other people without their permission where the law requires it.
• Attempt to reverse engineer, decompile, or disassemble the app.
• Scrape, crawl, or use automated means to access the Service.
• Interfere with or disrupt the Service or its servers.
• Impersonate any person or entity.

9. Limitation of Liability

To the maximum extent permitted by law, Thunder Rebel LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the Service. Our total liability for any claim arising from the Service shall not exceed the amount you paid us in the twelve (12) months preceding the claim.

10. Indemnification

You agree to indemnify and hold harmless Thunder Rebel LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from your use of the Service or violation of these Terms.

11. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied. We do not warrant that the Service will be uninterrupted, error-free, or secure.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the State of Wyoming, USA, without regard to its conflict of law provisions. Any legal action or proceeding arising under these Terms shall be brought exclusively in the courts of Wyoming.

13. Modifications

We reserve the right to modify these Terms at any time. Material changes will be posted on this website. Your continued use of the Service after modifications constitutes acceptance of the updated Terms.

14. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms or for any other reason at our sole discretion. Upon termination, your right to use the Service ceases immediately.
